I hate when I get these kind of Machiavellian thoughts but:
What are the odds that the Dems are excited to have Roe V. Wade overturned so they can use the legal status of abortion as a “we don’t have to offer anything else” trump card the way the right has? The only reason I can think to not believe this is that it implies they give a shit about winning in the first place…
In general a hard-conservatove originalist Court is good for the Dems because its a go-to excuse for not passing any reform legislation.
Being in support of abortion rights is not nearly as polarizing of an issue as those who are against it. Being against abortion is one of the most energizing issues in the entire country. There’s very little on the left that is even remotely comparable to how people bomb abortion clinics and seriously harass doctors that perform abortions.
This is a bad take, the Dem strategy over the last decade has been to use court decisions to make up for the fact that they were totally unable to successfully legislate.
The ACB confirmation is a total disaster to that strategy, the party knows they’re fucked if they don’t pack the court. The sad thing is even though they know they’re fucked, they still probably won’t actually do it.
Rest assured, the dems have arrows in their quiver, and those arrows will remain in the quiver no matter what happens.
