No lawyer who wasn’t an ideological fascist would seriously stand in court and argue that some vague “tradition” can overthrow a thousand years of common law precedent. There’s billionaire funded dark money groups explicitly set up to write right-wing legislation, appoing right wing AGs, appoint right wing judges. They weren’t going to set up infrastructure to control every aspect of putting cases before the Supreme Court and having their side win, and then just not do that.
That’s understandable. I had a mental block for a while because I was imagining concentration camps. Not that the US is above camps. It just didn’t click for me. Then someone pointed out that the US has a deeper history of vigilante violence being excused by the law. The whole “it’s now legal to run over protesters with your car” laws popped into mind and it makes a lot more sense to me.
The proud boys and the various right wing militias are already acting as the militant wing of the Republican Party in some areas. Many states are quickly approaching the point of making it illegal to be visibly trans in public. Police continue to do extrajudicial killings every day or two, but the media rarely covers them anymore. It’s suddenly acceptable for sitting senators to discuss the reinstatement of racial segregation by the courts. Slave patrols originally formed in response to non-slave states refusing to dedicate resources to returning escaped slaves and the Democrats response to red states rolling back the clocks by 100 years is “lol just move :4Head:” and hardening rights within the borders of blue states, which will inevitably lead back to a constitutional crisis. There are half a dozen right wing groups working towards calling a constitutional convention who have made astounding progress over the last couple years.
It all adds up and I see pogroms in the next few years and mass graves within 10 if things continue as-is. They’re coming for contraception access. They’re coming for racial integration. They’re coming for the 14th amendment and for gay marriage and for gender protections and for expanded suffrage. They’re coming for social security. They’re coming for Medicaid. They’re coming for it all.
I was imagining concentration camps
We have concentration camps for migrant workers and refugees crossing the border, and the US Prison System is basically an internal camp system. The Nazis didn’t start out with extermination camps. They worked towards it incrementally for years.
For sure. I was just having trouble seeing how the immediate future tied into that build up on an intuitive level. It seemed like an awful present disjoint from an awful future. Seeing the continuity is making me feel like I’m finally feeling a proportionate amount of urgency.

Holy fuck they need to learn how to order the parts of their sentence. “The right to transitioning treatments is not rooted in our nation’s history and tradition, for anyone - adult or child” is a much less ambiguous way to say that horrifically ghoulish and evil sentence that they should’ve been hanged for writing.
What they are attempting to say is because trans people “didnt exist” in the past and the right to trans care wasn’t mentioned in the constitution, your medical care isn’t protected.
These specific chuds didn’t exist in the past and I see no reason they have a right to keep existing.
